I agree to this Agreement regarding the Carside Fetch Service (the “Service”) operated by the Good Clean Dog entity operating at the location providing the Service (“GCD”).

● GCD may refuse, suspend or permanently revoke the Service at any time, with or without cause; noncompliance may cause suspension or removal without refund.

● I will keep a valid card on file and pay in advance or immediately after pick-up.

● I represent and warrant that I am the sole dog owner or authorized to bind all owners; this Agreement binds and is enforceable against me and all owners.

● I will follow all GCD safety rules, staff instructions, and procedures and use a GCD-approved harness and restraint.

RELEASE OF LIABILITY

I voluntarily assume all Service risks, including personal injury, property damage, and injury to or loss of my dog. I release, waive, and forever discharge GCD and its affiliates, owners, officers, managers, employees, agents, and contractors and all their successors (the “Released Parties”) from all claims, losses, liabilities, damages, costs, and expenses (including attorneys’ fees) (“Losses”), whether known or unknown, arising from the Service or this Agreement, including negligence, but excluding gross negligence or willful misconduct.

INDEMNIFICATION

I will indemnify, defend, and hold harmless the Released Parties from all Losses arising from my breach, my negligent or wrongful acts or omissions, injury to or caused by my dog, or property damage caused by me or my dog in connection with the Service.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GCD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THIS AGREEMENT OR THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. GCD’S AGGREGATE LIABILITY FOR ANY CLAIM UNDER THIS AGREEMENT OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY ME TO GCD FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

DISCLAIMER OF WARRANTIES

GCD PROVIDES THE SERVICE “AS IS” AND “AS AVAILABLE” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DISCLAIMS ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

DISPUTES

Any dispute regarding this Agreement or the Service shall be resolved exclusively under Missouri law by binding arbitration administered by the American Arbitration Association in St. Louis County under its Consumer Arbitration Rules; the decision is final and binding.

MISCELLANEOUS

GCD may modify this Agreement by email or facility posting, which I accept by continued participation. Invalid provisions do not affect the remainder. This Agreement binds and benefits GCD, me, and our successors and assigns. I may not assign any right or obligation in this Agreement; prohibited assignments are void.
